Councillors were shocked last week when they were told by acting municipal manager Temba Mnguni that a position for the municipal manager could not be advertised because Naidoo had not been dismissed.
The municipality's communication officer Yoliswa Ramokolo confirmed this week that Naidoo was not given a dismissal letter.
"The reasons will be discussed in the next Council meeting. Technically he (Naidoo) is still on suspension and not dismissed."
In his position as municipal manager, Naidoo reported to the executive mayor Zamuxolo Peter. The letter of dismissal should therefore have been issued by the Mayor's office.
He was found guilty on charges of misconduct in March this year and was dismissed, in accordance with the disciplinary process.
DA caucus leader Les Reynolds said as councillors they had been taken aback by the news that Naidoo had not served with a letter of dismissal.
"We are waiting for a report from Planga about that in the next Council meeting. As far as I am concerned, he is not an employee at Makana. The disciplinary committee dismissed him of behalf of the Council," said Reynolds.
He said there were rumours that there were some people in municipal structures who wanted Naidoo back.
Asked his opinion as to whether the mayor was at fault for failing to serve Naidoo with a letter of dismissal, Reynolds said he wasn't.
"The mayor recused himself in that matter. He did not participate in any of the meetings, so it cannot be his fault that Naidoo was not officially dismissed," Reynolds said.
Ramokolo said Council would hear an update on the matter in the next Council meeting, on 20 June.
