A 28-year-old man who attacked his mentally disabled neighbour in the garden of her Aliwal North home was found guilty of attempted rape in the Grahamstown High Court on Thursday.

Judge Nomathamsanqa Beshe was unable to find Bongani “Mbazo” Simenukana guilty of rape because the doctor who examined her had found no evidence of penetration.

According to court documents Simenukana, who lives in the same neighbourhood as the 27-year-old mentally disabled woman, was discovered naked with her, in her garden and ran away, leaving behind his clothes.

The woman's grandmother found her still lying on her back, alongside her clothes and Simenukana's. Also mute, the court heard that she cannot take care of herself and depends on others for her personal needs.

State prosecutor Glen Turner asked the court for time to recall a psychologist to assess the impact on the woman before sentencing.
