Dondashe and his girlfriend had been on their way home from Dinangwe Tavern, in the township. The trial has been running for more than a year and, after the last hearing, in December, Judge Nomathansanqa Beshe set down 26 January 2011 for judgment.

Defence attorney Mthuthuzeli Xozwa said his client should be acquitted of all the charges, arguing that the way Dondashe's girlfriend had identified the attacker was inadequate. "There are a lot of coffee-coloured males who have dreadlocks in the township," said Xozwa.

In response, Beshe asked, "How else can one identify a person without using a description of their physical appearance?" ANC Youth League members have been picketing outside the Grahamstown High Court throughout the trial.
