Murder accused 36-year-old Mzoxolo Reginald Schoeman was refused bail yesterday at the Grahamstown Magistrate’s court after he allegedly stabbed a man five times in Extension 2 on Saturday evening.

Investigating Officer John Manzana told the court that while the brother of the deceased was “in his own yard” having a conversation with his friend, the accused allegedly came between the two; they then argued over the distraction that he had made.

The accused went home and came back with a group of youngsters who started throwing stones at the deceased’s home. “When the deceased rushed to close the gate to protect his brother, the accused stabbed him five times and the deceased died on the spot,” said Manzana.

In 2000, Schoeman, who is on treatment for leukaemia (blood cancer), was sentenced for more than ten years imprisonment for several criminal offences some include house-breaking, theft, kidnapping, attempted murder and rape.

Schoeman, who has two pending cases excluding this one, said that he was defending himself from the two brothers who were attacking him with knives. When the police arrived, Schoeman was still carrying a knife and admitted in stabbing the deceased.

Manzana said that while arresting Schoeman, he threatened the deceased’s brother and said that he was coming back for him. “According to his records, the accused is getting worse and worse, this offence is very serious. He is committing crimes that are more serious than before. To protect the witness, the accused should not be granted bail, and according to the evidence he could even distract my investigation,” added Manzana.

Magistrate Nomnikelo Jebese said that no visible injuries were sustained by the accused when he appeared in court on Monday, “I would have noticed because it was only two days after the incident” she said. “It is common sense for a person to defend themselves when they are being attacked by two people carrying knives. The two people carrying the knives are in a better position to stab the victim, but the accused didn't have any injuries, which is strange,” she added.

On the other hand, the 26-year-old Siyabulela Kiswa who has been accused of fatally wounding a man with a cricket bat in Aiken Street on Sunday morning over a money argument will appear on Monday for a bail hearing at the Grahamstown Magistrate’s court.
