Kemp raped the girl numerous times between 2003 and 2004. Kemp was a 15 year old student at the time and went to Hoerskool PJ Olivier. The girl attended a day care centre at Kemp’s mother’s house.
Kemp will serve his house arrest in Somerset West where he works as a computer technician. He was also sentenced to six months’ imprisonment, suspended for five years.
Kemp’s prison sentence was waived because he was a minor when he committed the crime and he had no previous convictions.
Magistrate Samson Dunywa said Kemp should not be sentenced as an adult because a 15 year is not mature enough to “know the consequences of his actions”.
The fact that Kemp is taking medication for depression and that he received a positive report from the probation officer also contributed to him not serving jail time.
Dunywa said that “the incident traumatised the victim and affected her school life and development”.
He said according to the report from the psychologist she had to attend 40 sessions of psychotherapy but still shows symptoms of post traumatic stress disorder and that she continues to have flashbacks.
That statement was challenged by Charl van Rooyen in Kemp’s defence saying jailing Kemp would not bring down the crime rate.
