Councillor acquitted of assault

A Makana councillor was acquitted of assault charges in the Grahamstown Magistrate's Court after he stood accused of stabbing a man and punching him in the face.

Mncedisi Gojela was relieved yesterday when magistrate Ntsoki Moni acquitted him of charges of assault with the intent to cause grievous bodily harm.

Gojela was accused of assaulting Extension 7 resident Misumzi Hlebani at his house on 8 June.

The Ward 11 councillor denied stabbing Hlebani with a kitchen knife and punch the man in the face following an argument over an electricity meter box. Hlebani had allegedly gone to Gojela's house to request an electricity meter box from the councillor when the confrontation took place.

In handing down her judgement, Moni said there wasn't much evidence to tell the court what happened that day, adding that the state bears the burden of proving its case beyond reasonable doubt.
